•On December 4, 2013, the Minister of Industry announced
that Bill C-28 (the “Anti-Spam Legislation”) will come into
effect on July 1, 2014
•The Anti-Spam Legislation will prohibit the
sending of commercial electronic messages unless the sender has
consent and the message contains prescribed information
•Final regulations now provide an exemption for messages
sent by or on behalf of charities that have a primary purpose of
raising funds for the charity
–This is not a full exemption from all commercial
electronic messages from charities
–This exemption only applies to charities (i.e.
non-profit organizations are not exempt)
