application was commenced by self-described atheists asking the Tribunal
to consider whether materials explaining atheism should
have the same protection and ability to be available to students
as materials explaining or promoting mainstream religions, such
as Christianity or Islam

answer this question, the Tribunal needed to decide whether
atheism should be considered a “creed”, and thus a protected ground under
the Ontario Human Rights Code (“Code”)
